Research Assignment 2: American Law Reports
and Restatements of the Law
(due Feb. 25, 1999)
American Law Reports:
Using the American Law Reports Index, find an A.L.R. annotation that discusses
whether a contract can be rescinded if it was entered into by mistake. (A.L.R. is on
the ninth floor of the John Marshall library; the Index is at the end. Make sure that
you are using the current index -- check the date on the pocket parts.)
Read the first few sections of the annotation. Check the pocket part at the back
of the volume, if there is one, to see if the annotation has been superceded by a
newer one or if any new material has been added since it was published. Also take a
look at the list of related annotations to see if there is a different A.L.R.
annotation that might be more relevant to the issue. Then, record the following
information for the most relevant annotation that you located:

- Citation (volume number, A.L.R. series, and initial page number):
- Publication date:

Restatements of the Law:
Consult the Restatement (Second) of Contracts and try to find a section
that discusses which party to a contract should bear the cost of a mistake.
- Record the citation for the section that you found, in Bluebook form.
(Be sure to include the year that the restatement was published.)
- Find an Illinois case (state or federal) that cited to the above restatement
section, and give the citation for the case.
